G. S. R. ­­_____ – in exercise of the powers conferred by sub -section (6) of section 7 of the seamen’s Provident Fund Act, 1966 (4 of 1966) read with paragraph 20 of the Seamen’s Provident Fund Scheme, 1966, the Board with the approval of the Central Government, hereby makes the following further amendments in the Seamen’s Provident Fund (Staff and Conditions of services) Regulations, 1972 namely.

 

1.         (1)        These regulations may be called the Seamen’s Provident Fund (Staff and Conditions of Services) Amendments Regulations,   

                        2018.

            (2)        They shall come into force on the date of their publication in the official Gazette.

           

            (3)        Application-These rules shall apply to posts specified in column 1 of the Schedule annexed to these rules.

           

            (4)        Number of post, classification and scales of pay- The number of the posts, their classification, pay band and grade pay or pay

             scale attached thereto, shall be as specified in columns (2) to (4) of the schedule annexed to these rules.

 

            (5)        Method of recruitment, age-limit, qualification, etc-The method of recruitment, age limit, qualifications and other matters related

             to said posts, shall be specified in columns 5 to 14 of the aforesaid Schedule.

 

            (6)        Disqualification – No person:-

 

(a)        Who has entered into a contracted a marriage with a person having a spouse living, or

(b)        Who, having a spouse living has entered into or contracted a marriage with any person shall be eligible for appointment to any of

       the said posts:

 

Provided that the Central Govt. may, if satisfied that such marriage is permissible under the personal law applicable to such person and other party to the marriage and that there are other grounds for so doing, exempt any person from the operation of this rules.

 

(7)        Power to relax:-  Where the Central Govt. is of the opinion that it is necessary or expedient so to do, it may, by order, for reasons to be recorded in writing and in consultation with the Union Public Service Commission, relax any of the provision of these rules with respect to any class or category of person.

 

(8)        Saving – Nothing in these rules shall affect reservation, relaxation of age-limit and other concession required to be provided for the Scheduled Castes, the Scheduled Tribes, Ex-serviceman and other special categories of person in accordance with the order  issued by the Central Government from time to time in this regard.

           

            In the Seamen’s Provident Fund (Staff and Conditions of Services), Regulation 1972.-

 

(i)            In regulation 5 for sub-regulation (1), the following shall be substituted namely “(1) The commissioner shall be appointing authority to all posts specified in the First Schedule except for the post of Administrative-cum-Accounts
Officer for which the Board shall be the appointing authority”.

 

(ii)           For the First Schedule the following Schedule shall be substituted namely.
